How Common Are Drunk Driving Accidents in Las Vegas?
According to a recent report, Las Vegas ranks as the worst city in the United States for drinking and driving. There are approximately 4,300 arrests for driving under the influence each year in the city.
According to the National Highway Traffic Safety Administration, over 12,400 people were killed in alcohol-impaired crashes in the United States in a recent year.
What Must I Prove To Win My Drunk Driving Accident Case in Las Vegas, Nevada?
To recover compensation if you were injured in a drunk driving accident, you will most likely need to prove that the driver was negligent. To do so, you must prove the following four elements: duty of care, breach, causation, and damages.
You must establish these elements “by a preponderance of the evidence,” which means that it is more likely than not that something is true.
Duty of Care
You must show that the defendant owed you a duty of care, which is a legal obligation toward others. When driving, one usually has a duty to drive with a reasonable amount of care and caution. This includes following traffic laws, such as not driving while intoxicated.
Breach
You also must show that the driver breached or violated their duty of care. Driving under the influence would certainly be a breach of a driver’s duty of care. However, it is not always easy to prove that a drunk driver was intoxicated if a breathalyzer test was not performed right after the accident.
Nevada law prohibits operating a motor vehicle if one’s blood alcohol concentration is equal to or greater than .08% for adults or .02% for minors. A defendant who violates a statute, such as Nevada’s prohibition on drunk driving, is automatically considered to have breached their duty of care.
This principle is known as negligence per se. If the drunk driver is convicted of drunk driving charges in a criminal proceeding, negligence per se may apply in your personal injury case, which will greatly simplify your burden of proving that the driver was negligent.
Causation
You must then show that the defendant was the factual and legal cause of your injuries. “Factual cause” means that your injuries would not have occurred without the other party’s actions.
“Legal (or proximate) cause” means that the defendant can be held legally responsible for your injuries because they were a reasonably foreseeable consequence of the defendant’s actions.
Damages
Finally, you must show that you suffered an injury or loss as a result of the defendant’s actions.
What Damages Are Available After a DUI Accident in Las Vegas?
A victim of a drunk driving accident may be entitled to many types of damages. They can be divided into two main categories: economic damages and non-economic damages.
Economic damages relate to the financial consequences of the accident or injury. These include things like past and future medical expenses, vehicle damage, property damage, and lost wages. In short, they are the tangible losses you sustain as a result of the accident.
In contrast, non-economic damages relate to the intangible, emotional, or psychological consequences of the accident or injury. Non-economic damages include pain and suffering, mental anguish, disability and the impacts it has on one’s life, loss of companionship, and diminished quality of life.
When you hire one of our attorneys, we’ll explain which damages may be available in your case and will fight for you to receive compensation for all of your drunk driving accident-related damages.
