How Common Are Rideshare Accidents?

Finding data on Uber and Lyft accidents isn’t easy. Nevada’s Department of Transportation doesn’t specifically keep track of rideshare accidents in the state. Uber and Lyft drivers use their own personal vehicles–so rideshare accident data is grouped with other types of accidents.

However, Uber has conducted its own safety reports. According to their own data, traffic fatalities involving Uber vehicles increased by 7% from 2017 to 2020. From 2019-2020, 101 people were killed in motor vehicle accidents involving Uber drivers.

While it’s tough to find precise data on the number of Uber accidents and injuries that occur in the U.S., some research does indicate that rideshare services are making the roads more dangerous generally.

One study used National Highway Traffic Safety Administration (NHTSA) research to evaluate the impact of Uber and Lyft. According to that study, fatal car accidents increased by between 2% and 4% each year since rideshare companies were introduced in major U.S. cities.

What Is the Value of My Las Vegas Uber Accident Case?

Calculating the value of your case is one of our first steps in the legal process. It will provide the basis for our negotiations with the insurance companies.

The value of your case is dependent on the unique facts involved, such as:

  • The severity of your injuries
  • The nature of the crash
  • How the injuries impact your daily life
  • The cost of your medical treatment
  • Your prognosis and whether you will require ongoing medical care and rehabilitation
  • The value of any wages you lose if you’re unable to work during recovery
  • The psychological impact of the accident
  • Whether you contributed to the accident

As in any auto accident case, the amount of insurance coverage that’s available can impact your case value. The issue is particularly important in Uber accident cases, where multiple insurance policies may be available.

Different insurance policies may be available, including:

  • The Uber driver’s own insurance policy
  • Uber’s commercial insurance coverage
  • A third-party’s insurance coverage

The Uber driver must carry car insurance like anyone else. However, whether their personal insurance policy will apply to the accident depends, in large part, on the driver’s status at the time of the crash.

Uber’s Commercial Insurance Coverage

Because Uber and Lyft classify drivers as independent contractors, they can’t be held directly liable when those drivers cause accidents. However, state law now requires Uber and Lyft to purchase commercial insurance to cover damages sustained by rideshare accident victims.

Two levels of coverage are available, depending on the driver’s status at the time of the accident.

If the Uber driver is waiting for a ride request but hasn’t accepted one yet, the following third-party liability coverage is available:

  • $50,000 in bodily injury liability (BIL) per person
  • $100,000 in BIL per accident
  • $25,000 in property damage liability (PDL) per accident

This coverage is only available if the driver’s personal auto insurance does not cover the accident.

Once the driver accepts a passenger request, the following coverage limits apply:

  • $1,000,000 in third-party liability coverage
  • Uninsured/underinsured motorist coverage (or first-party injury insurance coverage)
  • Contingent comprehensive and collision coverage

The $1 million policy is available for the entire duration of the Uber ride.

Third-Party or Personal Auto Insurance Coverage

If someone other than the Uber driver was responsible for the crash, their insurance may be available. For example, if a third-party motorist caused the crash, you can seek compensation from that at-fault driver.

You can also seek compensation from the Uber driver’s personal insurance company if the Uber driver was not logged into the Uber app at the time of the crash.

What Types of Damages Can Uber Accident Victims Recover in Nevada?

The value of your case depends on your total damages. You can seek compensation for economic and non-economic damages.

Depending on the situation, you may be entitled to compensation for:

  • Current medical bills
  • Future medical expenses
  • Lost wages and lost future earning capacity
  • Rehabilitation
  • Property damage
  • Pain and suffering
  • Emotional distress
  • Depression
  • Fear
  • PTSD
  • Diminished quality of life
  • Physical disfigurement and scarring
  • Loss of consortium

In limited cases, it may be possible to recover punitive damages as punishment for a defendant’s intentional wrongdoing or gross negligence.

How Can Nevada’s Shared Responsibility Law Impact My Right to Financial Compensation After an Uber Crash?

Nevada follows a modified comparative negligence law with a 51% bar to recovery.

Your compensation will be reduced by your percentage of fault if you’re less than 51% responsible for the accident. Once your percentage of fault reaches 51%, you’re completely barred from recovering any compensation at all.

Hiring a personal injury attorney can benefit you significantly in this regard, as a lawyer can advocate for your interests and respond to allegations of blame effectively.

  • Tailgating
  • Speeding

What Is Negligence and Why Is It Important in My Las Vegas Uber Accident Case?

Nevada is an at-fault insurance state. After an accident, the responsible party pays the damages of others. So, you’ll have to prove that someone else caused the accident to recover compensation.

Most of the time, that means proving negligence. Negligence is a failure to exercise reasonable caution under the circumstances. It means that someone else owed you a legal duty of care, breached that duty, and caused an accident that left you with injuries or damages.

How Long Do I Have to File a Claim After an Uber Accident in Las Vegas?

Under Nevada law, you have two years from the date of the accident to take legal action. Once the two-year statute of limitations passes, you can no longer sue for damages.

Since there are exceptions to the statute of limitations, it is best to contact our law office as soon as you can to protect your rights and confirm the amount of time you have to file a lawsuit.
