What Is an Open Container Under Nevada Law?

According to Nevada Revised Statutes (NRS) 484B.150, an open container is one that has been opened or whose seal has been broken. Open containers include, but are not limited to, bottles, cans, or other receptacles containing an alcoholic beverage. It includes containers that have been partially consumed or transferred to another vessel, such as a solo cup or glass.

Nevada Open Container Laws in Vehicles

It is illegal for a driver or passenger to have an open container of alcohol in the passenger area of any motor vehicle on a public highway or street. The law applies whether the car is moving or stationary. Even if the driver is sober and no one is drinking, simply having an open container in the passenger area is a violation.

Penalties for a misdemeanor open container violation include:

  • Up to $1,000 in fines
  • Up to six months in jail
  • Community service may be required

Open container violations occurring in a work zone or pedestrian safety zone carry additional consecutive penalties. You can face higher fines and longer sentences.

Exceptions to the Open Container Law for Vehicles in Nevada

There are limited exceptions to Nevada’s open container laws for motor vehicles. 

Exceptions include:

  • Commercial vehicles: Passengers in vehicles used solely for the transportation of individuals in exchange for compensation (e.g., limousines, buses) may be exempt, but this does not apply to rideshares.
  • Storage: If the open container is stored in an area inaccessible to the driver or passengers, such as the trunk, it may not constitute a violation.
  • RVs and house trailers: You may have an open container in the living quarters of a house trailer or house coach. The open container cannot be within the driver’s area.

These exceptions are narrow, so it is important to understand when they apply to avoid unintended violations of Nevadaโ€™s open container laws.

Open Container Laws in Public Areas in Las Vegas, Nevada

Nevada law allows for open containers in certain public areas, but there are restrictions:

Las Vegas Strip (Unincorporated Clark County)

It is legal to carry open containers of alcohol if you are 21 or older on the Las Vegas Strip. However, the drink must be in a plastic or paper cup or an aluminum can. Glass containers are strictly forbidden. 

Downtown Las Vegas and Fremont Street (Incorporated City of Las Vegas)

Open containers are generally allowed in plastic or paper cups provided they are purchased at a casino, bar, or restaurant with a tavern license. Both glass and aluminum containers are prohibited. Additionally, open containers cannot be within 1,000 feet of packaged liquor stores, hospitals, schools, churches, or homeless shelters.

Public Parks

Drinking alcohol in public parks is illegal unless a special permit is obtained. It is crucial to check with local authorities to determine which permits are required and the rules for consuming alcohol with those permits.
