One of the first questions drivers face after a car accident in Nevada is whether their car will be repaired or declared a total loss, often referred to as “totaled.” Insurance companies, not drivers, generally make that determination. Understanding how vehicles are considered “totaled” can help accident victims know what to expect and make informed decisions during the claims process.

What Does “Totaled” Mean?

A vehicle is typically considered “totaled” when the cost of repairs exceeds its market value. In other words, fixing the car would cost more than it is worth. However, states like Nevada impose their own definition. 

Insurance adjusters make this determination using Nevada law, valuation reports, and repair estimates. Even if a car appears repairable, hidden frame damage or the high cost of modern parts and technology can quickly push repair costs over the threshold.

How Does Nevada Law Define a “Totaled” Vehicle?

In Nevada, a vehicle is considered a total loss when the cost of repairs exceeds 65% of its pre-accident fair market value, also known as actual cash value (ACV). 

Here is what those terms mean:

  • Actual cash value (ACV): Your vehicle’s fair market value immediately before the accident, based on age, mileage, condition, and comparable sales.
  • Repair cost: The estimated cost to restore your vehicle to a safe, roadworthy condition.

For example, if your car’s actual cash value is $12,000 and the estimated repairs are $8,000, the repairs equal about 67 percent of its value. Under Nevada law, the car would be declared a total loss. The state’s 65 percent threshold means that vehicles with significant damage are often declared totaled, even if they are repairable. 

What Happens If My Car Is Totaled?

If your car is declared a total loss, the insurance company typically owes you the actual cash value of the vehicle, not the cost of replacing it with a brand-new model. This means you may not receive enough to buy an identical car unless you have gap insurance or new car replacement coverage.

Here is what usually happens after a car accident in Las Vegas:

  • The insurer takes possession of the totaled vehicle and pays you the actual cash value of the vehicle.
  • If you still owe money on a car loan, the payout will be sent to your lender first.
  • If you want to keep the car, you may be able to “buy back” the salvage at a reduced settlement amount, but the title will be branded as salvage.

An insurance adjuster will be able to walk you through the process and explain their valuation of your vehicle. If you financed or leased your car, it is especially important to review your loan or lease agreement. Many Nevada drivers discover that the insurance payout is less than what they still owe on the vehicle, leaving them “upside down” on the loan. 

Can You Dispute a Total Loss Decision in Nevada?

Sometimes, accident victims disagree with an insurer’s determination of their vehicle’s value. 

You may feel the car is worth more than what the company offers. In these cases, you can:

  • Request a valuation report to see how the insurer calculated actual cash value.
  • Provide your own evidence, such as receipts for recent repairs, upgrades, or comparable local vehicle listings.
  • Hire an independent appraiser to support your position.
